What is bankruptcy?

A voluntary bankruptcy is a proceeding in federal court brought by individuals or businesses who are unable to pay their debts as they come due and seek the protection afforded by the courts and bankruptcy law. In some cases, a bankruptcy trustee will determine whether certain property should be sold to pay off some of the debts, or if the debtor is entitled to a “no-asset” bankruptcy where debts are discharged without the sale of any possessions. In other types of bankruptcies, the debtor’s assets and liabilities are restructured and reorganized in a way that lets the debtor make payments over a period of years in a manageable way. The end result is that a person or business exits bankruptcy either debt-free or with a significantly reduced debt load. Filing for bankruptcy triggers what is known as an automatic stay, meaning that all collection activities, including home foreclosure proceedings, immediately stop as soon as creditors are put on notice of the stay.
